ACTION:                   AUTHORIZE THE CEO TO EXECUTE A

                                    CONTRACT MODIFICATION FOR THE

                                    CONTINUATION OF PRELIMINARY

                                    ENGINEERING DESIGN SERVICES IN AN

                                    AMOUNT NOT TO EXCEED $4,777,432

 

 

RECOMMENDATION

Authorize the Chief Executive Officer to execute Change Order No. 3 to Contract No. PS-4310-0964, with Eastside LRT Partners, a Joint Venture, consisting of Parsons Brinckerhoff, Jenkins/Gales & Martinez, and Barrio Planners, Inc., for a total amount not to exceed $4,777,432, for continuing preliminary engineering design services.  This authorization is pending the Federal Transit Administration (FTA) approval to enter into final design.

BACKGROUND

The existing contract with Eastside LRT Partners for design services includes a first phase for four months to perform preliminary engineering (April 2001 through August 2001), and subsequently a second phase for four months to perform continuing preliminary engineering (August 2001 through December 2001).  In September 2001, the contract performance period was extended from December 2001 to April 2002, in order to support the project’s Supplemental Environmental Impact Statement/Supplemental Environmental Impact Report approval process.

 

This request is to proceed with continuing preliminary engineering design services for three months to begin at the conclusion of currently authorized continuing preliminary engineering design services, and will allow Eastside LRT Partners to progress with the critical design work pending FTA approval to


commence final design.  The critical work includes the tunnel and the two underground stations.  In addition, the consultant will continue to provide community outreach support services and California Public Utilities Commission (CPUC) coordination that is currently underway.

 

During the 3-month period, the definition of underground station architectural and structural design and seismic loading criteria, would be enhanced to ensure both the quality of the project’s architectural design and structural capacity.  The Design/Build (D/B) contractor will be required in the final design phase to incorporate the developed architectural concepts and the specified level of structural capacity with detailed and complete shop drawings.  This approach provides the D/B contractor with sufficient flexibility to design significant efficiencies with civil, mechanical, electrical, vertical transportation and other systems, while ensuring compliance with developed architectural concepts and the structural integrity of a heavily used public facility situated over a blind fault in an active seismic region.

 

The design will include, but is not limited to, the completion of all basic layouts of drawings incorporating criteria and concepts with only final details left to be developed.  This design level will permit the Metro to validate the schematic design preliminary engineering concepts and allow the D/B contractor to advance them to the final design stage for construction.  The design documentation at this point should provide a clear indication of the design being pursued.

 

Upon conclusion of this design period, the documents will provide a more complete representation of the project scope so that all participating agencies can review the proposed construction, and serve as a basis for obtaining concurrence from city, county, state (including CPUC), federal agencies, utilities, and railroads, to provide a basis for final design within a D/B Request for Proposal.

 

FINANCIAL IMPACT

 

The funding of $4,777,432 for this service is included in the FY02 budget in Cost Center 4320 (Central Area Team) under Project 800088 (Eastside LRT), Line Item No. 50316 (Professional & Technical Services).  In FY02, $9,912,018 was expended on this line item.

 

ALTERNATIVES CONSIDERED

 

The Board could suspend design work until the FTA approves the commencement of final design.  This alternative is not recommended since it would delay the project completion, and the suspension in design work will cause the project to incur additional demobilization and remobilization costs.
